SparkAbility LLC (“SparkAbility,” “we,” “us,” or “our”) respects the privacy of our members, supporters, families, and website visitors. This Privacy Policy explains how we collect, use, store, and share personal information in connection with our website, registration process, communications, membership services, social activities, coaching services, friendship and relationship matchmaking services, and related SparkAbility programs.
By accessing or using the SparkAbility website, submitting a registration form, communicating with SparkAbility, or participating in SparkAbility services, you provide your affirmative express consent to the collection, use, processing, and storage of your personal information, including sensitive disability-related information, in accordance with the terms of this Privacy Policy. If you do not agree, please do not use our website, submit registration materials, or participate in our services.
1. Information We Collect
The information SparkAbility collects depends on how you interact with us.
Website Information
The SparkAbility website itself may collect limited technical information automatically through Squarespace and related technologies. This may include information such as:
IP address
Browser type
Device type
General location information
Pages viewed
Website interaction information
Cookies and similar technologies
This information may be used to operate, maintain, understand, and improve our website.
Registration Information
Individuals who choose to register with SparkAbility are directed from our website to a registration form hosted through Jotform.
A registration may be completed directly by a prospective Member or by a Supporter on behalf of a prospective Member. Our registration form specifically permits both types of registration.
Depending on the registration, SparkAbility may collect:
Member name
Supporter name
Email address
Telephone number
Relationship between a Supporter and Member
Member date of birth
Gender
Mailing or residential address
Member and/or Supporter contact information
Our registration form also allows Members to identify whether they would like a Supporter included in communications with SparkAbility.
2. Disability and Other Sensitive Information
Because SparkAbility provides social, friendship, relationship, and confidence-building services for adults with disabilities, our registration process may request information relating to a Member’s disability.
For example, the registration form asks Members or Supporters to tell SparkAbility about the Member’s disability and to provide other information they believe is helpful for SparkAbility to know.
SparkAbility may also collect information regarding:
Social confidence
Comfort meeting new people
Friendship experiences
Dating or relationship experiences
Relationship and friendship preferences
Preferred characteristics of potential matches
Interests and hobbies
Socialization preferences
Areas in which a Member would like additional confidence or support
The registration form asks about dating and friendship goals, gender preferences, preferred age ranges for matches, and other matchmaking preferences.
SparkAbility collects this information for the purpose of understanding Members and determining which SparkAbility services, social opportunities, coaching options, friendship opportunities, or potential matches may be appropriate.
SparkAbility is a social-services and matchmaking company. SparkAbility and its employees are not acting as medical professionals, healthcare providers, therapists, or legal professionals through these services. SparkAbility is a social, recreational, and matchmaking organization. SparkAbility, its owners, and its employees are not acting as medical professionals, healthcare providers, licensed therapists, psychiatric crisis intervention specialists, or legal professionals through any services. SparkAbility does not provide medical care, skilled behavioral therapy, psychiatric crisis support, personal care assistance (activities of daily living), or custodial adult supervision. SparkAbility services are strictly for social, recreational, and coaching purposes and are not substitutes for professional medical advice, diagnosis, treatment, or therapy. Any participant requiring personal care assistance, medication administration, or specialized supervision must be accompanied by their own qualified personal caregiver or support professional at all times during SparkAbility activities and events.
3. Photographs
As part of registration, SparkAbility may ask a Member to provide a photograph.
The registration form states that submitted photographs are used for internal purposes only.
SparkAbility may use a submitted photograph internally to identify a Member, maintain Member records, assist SparkAbility staff with providing services, and assist with appropriate friendship or relationship matching.
SparkAbility will not use a registration photograph for public advertising, social media, or promotional purposes solely because the photograph was submitted through the registration form.
If SparkAbility wishes to use a Member's photograph publicly for marketing, advertising, promotional materials, social media, or other public-facing purposes, SparkAbility may request separate permission or authorization.
4. How We Use Personal Information
SparkAbility may use information we collect to:
Process and review registrations
Communicate with Members and Supporters
Schedule initial consultations or informational sessions
Create and maintain Member records
Understand a Member's interests, goals, needs, and preferences
Provide friendship or relationship matchmaking services
Identify potentially compatible Members
Recommend SparkAbility activities, events, groups, classes, or services
Provide life coaching or dating coaching services
Coordinate social activities and events
Provide customer and Member support
Manage memberships and accounts
Process billing and payments
Maintain internal business records
Operate and improve SparkAbility
Protect the safety and security of Members, staff, and our services
Comply with applicable legal obligations
SparkAbility's registration form informs registrants that submitted information will be stored to assist SparkAbility's matchers throughout the process.
5. Information About Members Submitted by Supporters
SparkAbility permits certain individuals, referred to as Supporters, to submit registration information on behalf of a Member.
A Supporter may therefore provide SparkAbility with personal information about another individual, including contact information, disability-related information, interests, preferences, social experiences, and other information relevant to SparkAbility services.
Supporters must provide information that is accurate and truthful. Because adult prospective Members are presumed to possess legal capacity under applicable law, any Supporter submitting information on behalf of an adult prospective Member represents and warrants that they hold formal legal authority (such as a valid court order of legal guardianship or power of attorney encompassing such authority) or the adult prospective Member's verified, informed consent and authorization to submit their personal and disability-related information to SparkAbility. SparkAbility reserves the right to request proof of legal guardianship, power of attorney, or written authorization at any time.
SparkAbility may communicate directly with a Member, a Supporter, or both depending on the information and communication preferences provided during registration.
6. How We Store Information
SparkAbility may store and manage personal information using third-party business platforms and cloud-based services.
Currently, these may include:
Jotform, which is used to host and process SparkAbility's registration forms;
Google Drive and Google WorkSpace Tools (Including Google Sheets, Docs, Forms), which SparkAbility utilizes with access-control, administrative, and permission based safeguards to organize and maintain Member and business records;
Xero Accounting, which SparkAbility uses for invoicing, accounting, billing, and payment-related activities; and
Squarespace, which hosts the SparkAbility website.
These companies may process information on SparkAbility's behalf according to their own terms, privacy policies, and security practices.
SparkAbility does not control the independent technical operations, infrastructure, or data security architecture of these third party systems, and cannot warrant or guarantee the security of the third party platforms.
7. Payment Information
Membership fees and other amounts owed to SparkAbility may be invoiced and processed through Xero Accounting and associated payment-processing services.
SparkAbility does not intend to directly collect or store complete credit-card or bank-account information through its Jotform registration form.
Payment providers may collect financial information necessary to complete a transaction. The handling of that information is also subject to the privacy and security practices of the applicable payment provider.
8. When We May Share Information
SparkAbility does not sell Member or Supporter personal information as part of its ordinary business operations.
We may disclose personal information when reasonably necessary to:
Provide SparkAbility services;
Operate our website and registration systems;
Process payments;
Store and maintain business records;
Work with service providers that support our operations;
Protect Members, staff, or others from safety or security risks;
Investigate suspected misuse or fraud;
Comply with applicable laws, regulations, subpoenas, court orders, or governmental requests; or
Protect SparkAbility's legal rights.
Service providers may include organizations such as Jotform, Google, Squarespace, Xero, payment processors, professional advisors, or other technology and business vendors used by SparkAbility.
SparkAbility does not intend for service providers to use Member information for their own unrelated purposes except as permitted by their agreements and applicable law.
9. Matchmaking and Member Information
Because SparkAbility provides friendship and relationship matchmaking services, certain information about one Member may need to be communicated to another Member when SparkAbility believes there may be an appropriate friendship, dating, relationship, or social connection.
SparkAbility will seek to limit information disclosed for matchmaking purposes to information reasonably appropriate for facilitating the potential connection.
Information concerning a Member's specific disability diagnoses, clinical or accommodation notes, private contact details (such as direct phone numbers, personal email addresses, or physical addresses), or other sensitive information will never be disclosed to another Member or prospective match without prior affirmative consent, communications, or other sensitive information will not automatically be shared with another Member merely because the individuals are being considered for a match.
SparkAbility may communicate appropriate introductory information to facilitate a potential connection while attempting to respect the privacy and preferences of the individuals involved.
NEW JERSEY INTERNET DATING SAFETY ACT NOTICE: PURSUANT TO N.J.S.A. 56:8-168 ET SEQ., SPARKABILITY DOES NOT CONDUCT CRIMINAL BACKGROUND SCREENINGS ON ITS MEMBERS.
SparkAbility encourages all Members and Supporters to exercise caution and sound judgment when interacting with new acquaintances. Never share financial account information, send money, or disclose home addresses to individuals you have not met in person under safe, supervised, or public circumstances. SparkAbility offers social coaching and guidance, but cannot guarantee the character, background, or conduct of any Member.
10. Email, Telephone, and Other Communications
By providing contact information to SparkAbility, Members and Supporters may receive communications relating to:
Registrations
Appointments
Memberships
SparkAbility services
Events
Matchmaking
Coaching
Account or billing matters
Administrative matters
The registration form explains that the email address provided for initial contact will be used to send information about scheduling a 1:1 meeting and learning about next steps with SparkAbility.
Marketing communications, where used, may include instructions for opting out when required by applicable law.
11. Cookies and Website Analytics
Our Squarespace website and services connected to it may use cookies and similar technologies.
Cookies may help with website functionality, security, analytics, preferences, and understanding how visitors interact with the website.
Depending on the technologies enabled on the SparkAbility website, third-party service providers may also collect information through cookies or similar technologies.
Visitors may be able to manage certain cookies through their browser settings or through cookie controls made available on the website.
12. Data Security
SparkAbility takes reasonable administrative, technical, and organizational measures designed to protect personal information from unauthorized access, disclosure, alteration, loss, or misuse.
Because SparkAbility collects information that can be sensitive, including disability-related and relationship-related information, we take the privacy of Member records seriously.
However, no website, online service, database, cloud service, or method of electronic transmission can be guaranteed to be completely secure.
SparkAbility endeavors to align its data protection practices with recognized industry standards and regulatory guidance applicable to sensitive consumer information, proportional to the nature and scale of our business.
13. Data Retention
SparkAbility may retain personal information for as long as reasonably necessary to:
Maintain a Member's registration or membership;
Provide requested services;
Maintain matchmaking or service records;
Maintain appropriate business and accounting records;
Resolve disputes;
Protect SparkAbility's legal interests; or
Meet applicable legal obligations.
Different categories of information are retained in accordance with our operational retention schedule. For inactive or lapsed memberships, SparkAbility generally retains Member records and matchmaking profiles for a period of twelve (12) to twenty-four (24) months following membership lapse or termination, after which records are scheduled for secure deletion, anonymization, or archiving, unless longer retention is required for legal, tax, accounting, or compliance purposes.
When information is no longer reasonably necessary, SparkAbility may delete, anonymize, archive, or securely dispose of it, subject to applicable legal and business requirements.
14. Requests to Access, Correct, or Delete Information
Members and Supporters may contact SparkAbility if they would like to request that we:
Update inaccurate contact information;
Correct information contained in their SparkAbility record;
Provide information concerning personal information we maintain about them; or
Delete certain personal information, when appropriate and legally permitted.
Some information may need to be retained for legitimate business, safety, contractual, accounting, dispute-resolution, or legal purposes.
Requests may be subject to identity verification before SparkAbility takes action.
Additional rights may be available under applicable state privacy laws depending on your jurisdiction. SparkAbility will acknowledge and respond to verified consumer privacy requests within forty-five (45) days of receipt, subject to any lawful extension permitted by applicable law. Privacy requests should be submitted in writing to andy@spark-ability.com and must include sufficient details to permit reasonable identity verification.
15. Children's Privacy
SparkAbility's services are intended for adults.
SparkAbility does not knowingly offer its membership, friendship matchmaking, or dating/relationship matchmaking services to children under the age of 18.
If SparkAbility learns that personal information relating to a child has been submitted improperly, we may take reasonable steps to remove the information.
16. Third-Party Websites and Services
The SparkAbility website may contain links to third-party websites or services, including registration, payment, event, social-media, or other platforms.
When you leave the SparkAbility website and use a third-party service, that company's own privacy policy and terms may apply.
SparkAbility is not responsible for the independent privacy practices of third-party websites or services.
17. Changes to This Privacy Policy
SparkAbility may update this Privacy Policy from time to time to reflect changes in our services, technology, business practices, or legal requirements.
When the policy is updated, the Last Updated date at the top of the policy will be revised.
Material changes may also be communicated in another reasonable manner when appropriate.
